Abstract

Mental health professionals are bound by, sometimes competing, ethical and legal standards.   In certain situations, ethical standards conflict with one another and, worse, conflict with legal mandates.  In these situations, mental health professionals are faced with difficult decisions about how to proceed in order to uphold the ethical standards set forth by their profession while abiding by the law.  One of the most important dilemmas faced by mental health professionals, in terms of its potential impact, surrounds the issues of confidentiality and the duty to protect.  This already complex issue becomes further confounded when treating patients with HIV/AIDS.  In this CE, participants will (a) learn about the ethical and legal standards relevant to the confidentiality and duty to protect dilemma, (b) learn about the relevancy of this dilemma to situations involving HIV/AIDS, and (c) learn about the special considerations to be made when faced with this dilemma.

Bio

Dr. Tiffany Chenneville is an Assistant Professor in the Department of Psychology at the University of South Florida St. Petersburg.  She also serves as the Director of Behavioral Health and Psychosocial Services for the Pediatric and Adolescent Infectious Disease Program in the Department of Pediatrics, College of Medicine at the University of South Florida.  Her research and clinical interests are in the area of pediatric/adolescent HIV.  She is particularly interested in the legal and ethical issues that surround this disease.  She has published several articles and book chapters in this area and has an active program of research examining the competence of children and adolescents with HIV to participate in their medical treatment.  Dr. Chenneville also is a licensed psychologist in the state of Florida and a nationally certified school psychologist.
